  • These terms and conditions govern your use of this website; by using this website, you accept these terms and conditions and the privacy policy in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use this website. If you disagree with the privacy policy or any part of the privacy policy, you must not use this website.

License to Use Website

  • Unless otherwise stated, Crowd Influencing and/or its licensors own the intellectual property rights in the website and material on the website. Subject to the license below, all these intellectual property rights are reserved.

    • All users are expected to register for Crowd Influencing using their truthful information. Any false registration will result in immediate termination. No questions asked.
    • Business users are expected to communicate clearly with influencers. Be responsive and be accurate with your needs.
    • All conversations that users partake in (through the website) will be used as evidence if a dispute should arise.
    • No contact of influencer to business or business to influencer should be made outside of the Crowd Influencing website. If this problem is to arise, admins have the discretion for user termination.
    • Influencers and business users are required to strictly follow the contract created between the two users. The contract is legally binding and available for use if problems should arise.
    • Businesses are expected to make payment into escrow before job starts. Once the job is deemed complete, the business user is responsible for releasing payment to influencer.
    • Both users have the ability to start a dispute and enter their proof with the admin.
    • Should a dispute arise, both the business user and the influencer user should try their best to solve the problem before coming to the admin. All admin dispute decisions are final.
  • Influencer Account Acceptable Use Clause

    • All influencer accounts are expected to be honest and genuine about the social media accounts that they own or have control off. Any false or misguided promises will result in termination of that user.
    • No contact of influencer to business or business to influencer should be made outside of the Crowd Influencing website. If this problem is to arise, admins have the discretion for user termination.
    • Influencers and business users are required to strictly follow the contract created between the two users. The contract is legally binding and available for use if problems should arise.
    • Influencer users must complete the job as tasked in the contract before requesting their payment be released.
    • Both users have the ability to start a dispute and enter their proof with the admin.
    • Should a dispute arise, both the business user and the influencer user should try their best to solve the problem before coming to the admin. All admin dispute decisions are final.

Privacy

  • All users are expected to register with Crowd Influencing using their truthful personal information. Because of this, Crowd Influencing protects all user information and will never give it out for any advertising or soliciting purposes outside of Crowd Influencing and its community.
  • All reviews of CrowdInfluencing.com submitted by users can be used for promotional purposes.

Restricted access

  • Crowd Influencing was created to be a safe environment for business. Any problems will be fixed by the admins and owners at their discretion.
  • Admins reserve the right to settle any disputes should they arise.
    • Admins will use proper evidence from all conversations in order to gather facts about the dispute.
    • Admins can make influencer users prove their social media account ownerships. This is to avoid any false ownership of social media accounts and protect the community from misguided contracts and disputes.
  • Admins have the right to ban any user if they make payment outside of the Crowd Influencing website. Any contact outside of the Crowd Influencing website is enough for user termination. Crowd Influencing was designed to help users find advertising and create a safe space for deals. If admins feel as though users are violating our purpose or avoiding the Crowd Influencing fee, admins have the right to ban users.
  • Admins reserve the right to ban any user from the website. User accounts can and will be deleted according to the admins discretion. IP addresses from banned users will also be blocked according to the admins discretion.
  • The legal team from Crowd Influencing reserves the right to settle minor to serious claims in court should any problems be escalated. Any user can and will be called in for the court hearings if they partake or have a part in the dispute.
  • Crowd Influencing has the right to restrict access to anyone under the legal age of 18.

User content

  • The Crowd Influencing team allows users to create their own user profiles. All content entered by users must be truthful and non-misguiding. All content must be appropriate for all users as well.
  • Admins have the right to view all conversations between users. Admins will monitor all conversations and delete information or messages as the admin deems necessary to protect privacy or to avoid payments outside of the Crowd Influencing website.

Limitations of liability

  • Any user contact outside of the Crowd Influencing website automatically voids any safety or privacy clauses that Crowd Influencing may have. It also voids payment protection for both users.
  • Crowd Influencing is not responsible for any loss of business, business defamation, or slowing of business.
  • If a business user chooses to work with an influencer user, the business is responsible for the post of the influencer and the rest of the provided content.
  • Any user is not able to legally attack or go after Crowd Influencing or its owners for any problems that arise out of the websites functioning or the final decisions of admins regarding disputes between users. Admins will find the best solution necessary for both parties, but after the admin has his/her say, the dispute is over and Crowd Influencing does not share responsibility.
  • All users are assumed to know the risk associated with using the Crowd Influencing website. All users will use the site at their own discretion. Crowd Influencing is not responsible for any offense, mistrust, or problems associated with using the website.
  • In the event of a breach of security by a third party, Crowd Influencing’s Terms of Use Section Privacy, sub-section 8. Is null and void. However, Crowd Influencing’s defense department will respond in an appropriate manner in order to try and protect all user’s information.

Exceptions and Unforeseeable provisions

  • For all unforeseeable situations, the owners of Crowd Influencing have the final say in all situations.
  • The owner with the most share of the company is the final deciding factor for all decisions regarding Crowd Influencing and its company’s actions.

Reasonableness

  • Crowd Influencing provides a safe space for all users. In return, Crowd Influencing expects all users to be reasonable and understanding with website performance, admin performance, and overall quality should problems occur.

Breaches of these terms and conditions

  • Any breach of these terms and conditions may result in a ban from using Crowd Influencing and/or legal action against the user.

Variation

  • Crowd Influencing may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of this website from the date of the publication of the revised terms and conditions on this website. Please check this page regularly to ensure you are familiar with the current version.

Payments and Contracts

  • Crowd Influencing acts as an escrow between business and influencers. For any dispute between the two parties, the admin will decide the outcome to his/her discretion. The contract, conversation, and any submitted evidence from the two users will be used in deciding the outcome.
  • Any contact outside of Crowd Influencing will be seen as a breach of these Terms of Use and it is the admins discretion for further resolution or to ban one or both users.
  • Crowd Influencing expects business users to create a contract that is obtainable by the influencer user. Crowd Influencing expects influencers to accept contracts knowing that they have to complete the task once accepted.
  • Both users will have the option to request the admin for escrow release once the job is complete.
  • The contract sent by the business user to the influencer is a legally binding document. Once an influencer accept, legal actions can be taken against any offending parties.
  • Business users must pay immediately when sending a contract to an influencer. That way, Crowd Influencing has the payment and can release it immediately after the task is complete.
  • Crowd Influencing urges business users to practice some reasonableness when an advertising task or job did not go as planned. Remember, to grasp an audience, an advertising post must be engaging, clear, and smart. Again, any dispute will be resolved by admin.

Choice of Law

  • Crowd Influencing is controlled by Texas Law. Any legal proceedings will be located in State or Federal Courts located in or directly adjacent to Travis County, Texas, USA.
